In the details, a woman filed a lawsuit against a man in which she demanded that he pay her the remaining 36,427 dirhams in the value of a bank loan and compel him to pay fees, costs and charges. The defendant asked her to take loans from banks as she could not afford them. And it was decided that the defendant should pay the amount she paid at the rate of 440 thousand and 107 dirhams, after which she paid the entire debt, so she filed a similar case and attached a document to her case. , copies of the debt claim and statement of accounting and judicial rulings, when the defendant submitted a reply memorandum and a copy of the documents reviewed by the court.
For its part, the court clarified the rationale of its ruling that, according to the Evidence Act, the plaintiff must prove his claim and the defendant has the right to deny it. It is documented that the plaintiff borrowed a total of 476 thousand 535 dirhams for the benefit of the defendant and it was determined in the case that she should pay the plaintiff 440 thousand 107 dirhams, the value of which she paid from the loan, which she borrowed and handed over to the defendant.
According to the certificate issued by the bank, it is proved that the plaintiff has paid the full Murabaha value and the amount of Murabaha value remaining after deducting the earlier settlement is equal to 36 thousand 427 dirhams, the court pointed out. , which is the amount claimed, and the court ordered the defendant to pay 36 thousand 427 dirhams to the plaintiff and ordered the defendant to pay fees, costs and charges.
