Dubai Week (the “Site,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (“DMCA”) policy explains how to report alleged copyright infringement on our Site and how we will respond.
Note: The DMCA is a United States law. We use this process as our standard notice-and-takedown mechanism for copyright complaints worldwide. Using this process does not waive any rights or remedies available under the laws of the United Arab Emirates or other applicable jurisdictions.
1) Designated Agent
To submit a notice or counter-notice under this policy, contact our Designated Agent:
DMCA Agent — Dubai Week
Email: editor@dubaiweek.ae
Preferred method: Email
If you require an alternative method of contact, please email us to arrange it.
2) Submitting a DMCA Takedown Notice (Copyright Owner)
If you believe that content on the Site infringes your copyright, please send a written notice to the Designated Agent including all of the following:
- Your contact details: full legal name, mailing address, telephone number, and email address.
- Identification of the copyrighted work you claim has been infringed (e.g., title, URL to an authorized version, registration number if available).
- Identification of the infringing material and its location on the Site (provide specific URLs and screenshots if possible) to allow us to locate the material.
- A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
Incomplete notices may delay processing. If your notice is unclear, we may request additional information to verify your claim.
3) What Happens After We Receive a Valid Notice
- We will promptly review the notice.
- If we determine the notice is valid, we may remove or disable access to the allegedly infringing material.
- We will notify the user who posted the material that it has been removed or disabled and provide them with a copy of the notice (with personal contact details redacted where appropriate).
- In appropriate circumstances, we may terminate repeat infringers’ accounts.
4) Submitting a Counter-Notice (User/Publisher)
If your content was removed or disabled due to a notice and you believe it was a mistake or a misidentification, you may submit a counter-notice to the Designated Agent containing all of the following:
- Your contact details: full legal name, mailing address, telephone number, and email address.
- Identification of the material that was removed or to which access was disabled, and the location where the material appeared before it was removed or disabled (specific URLs).
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your consent to jurisdiction: a statement that you consent to the jurisdiction of the courts of the United Arab Emirates and, if your address is outside the UAE, that you consent to the jurisdiction of any court in which Dubai Week may be found, and that you will accept service of process from the person who provided the original notice (or their agent).
- Your physical or electronic signature.
Upon receipt of a valid counter-notice, we may forward it to the original complainant and restore the material within a reasonable time unless the complainant notifies us that they have filed a court action seeking to restrain the user from engaging in the allegedly infringing activity.
5) Repeat Infringers
We may, in appropriate circumstances and at our discretion, disable or terminate accounts of users who are determined to be repeat infringers.
6) Misrepresentations
Under applicable law, any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages (including costs and attorneys’ fees). Please consider whether fair dealing/fair use or other exceptions apply before submitting a notice.
7) Other Rights and Policies
This policy does not limit our ability to remove content that violates our Terms of Use, Community Guidelines, or other policies. We may also preserve and disclose information as required by law or to protect our rights, users, and the public.
8) Language
This policy is provided in English. If we provide a translation, the English version will govern in case of conflict.
